This paper has three main goals. Firstly – to draw attention to the phenomenon of the democratic paradigm in the study of modern state systems (especially monarchical ones), characterise it and outline its sources. Also - to question the basis of this phenomenon (by pointing out, among other things, the durability of monarchical systems and the phenomenon of partial ‘re-monarchization’ – real or apparent – of certain contemporary republican systems on the examples of: Montenegro, Romania, the Czech Republic, Hungary and (...) Poland). Secondly, to present the negative consequences of the functioning of the democratic paradigm, also (paradoxically) those affecting the political practice of republics. Thirdly, to propose a way to reduce these negative consequences by changing the optics adopted in comparative studies about monarchies and republics. This change is based on the restoration, in comparative analyses of contemporary state systems (including monarchical ones), of the concepts of ‘mixed system’ and ‘monarchical principle’, which are still used in research on the history of the state and law, and should be disseminated in research on contemporary political systems and constitutional law. An explanation of the terms ‘mixed system’ and ‘monarchical principle’ as I use them here will follow in the final part of the paper. (shrink)

Despite increasing interest in studying arguments from deontic authority of the general form “(1) $$\delta$$ δ is a deontic authority in institution $$\varOmega$$ Ω ; (2) according to $$\delta$$ δ, I should do $$\alpha$$ α, C: therefore, (3) I should do $$\alpha$$ α ”, the state of the art models are not capable of grasping their complexity. The existing sets of critical questions assigned to this argumentation scheme seem to conflate two problems: whether a person is subject to an authority (...) of an institution in the first place and whether the command issued within the context of a particular institution is eventually binding. For this reason, we introduce (1) a set of Basic Critical Questions to scrutinize the former issue, and (2) a set of more detailed questions related to specific features, also referred to as “parameters”, of institutional environments (Intra-Institutional Critical Questions). We identify major elements of institutional environments in which authoritative utterances are made and the crucial parameters of arguments from deontic authority. The selected evidence from the decisions of the Polish Supreme Administrative Court helps us show how these parameters may be used to reconstruct subtypes of this argument scheme, with their associated sets of critical questions. In specific institutional contexts, such detailed schemes are capable of grasping the complexity of appeals to deontic authority and thus should be used rather than general schemes. The reconstruction of argumentation schemes with critical questions shows how particular arguments may successfully be attacked. (shrink)

The thesis of the paper holds that some future developments of argumentation theory may be inspired by the rich logico-methodological legacy of the Lvov–Warsaw School (LWS), the Polish research movement that was most active from 1895 to 1939. As a selection of ideas of the LWS which exploit both formal and pragmatic aspects of the force of argument, we present: Ajdukiewicz’s account of reasoning and inference, Bocheński’s analyses of superstitions or dogmas, and Frydman’s constructive approach to legal interpretation. This paper (...) does not aim at exhaustive elaboration of any of these topics or their usefulness in current discussions within argumentation theory. Rather, we intend to indicate chosen directions of a potentially fruitful research program for the emerging Polish School of Argumentation which would consist in application of methods and conceptions elaborated by the LWS to selected open problems of contemporary research on argumentation. Norway is perceived as a country with a clear international identity. The aim of the article is to investigate the sports diplomacy of Norway and to examine its influence on the international brand of this country. The author will define the term “sports diplomacy” and attempt to outline the strategy of Norway’s public diplomacy; an analysis of the methods used in Norwegian sports diplomacy will follow. ABSTRACT The aim of this article is to show how sport can matter in international relations. Sport can be a subject or a tool of international relations. It can be used by states or geopolitical blocks to display their alleged superiority or any other desired characteristic. Governments may desire athletic victories, which are meant to imply, for example, the power of the state and its political and economic system. Participation in sport can also be used for political reasons on an (...) international scale; a number of political objectives can be achieved by states by participating in sports events. Vision is inseparably connected to perceptual awareness which can be seen as the culmination of sensory processing. Studies on conscious vision reveal that object recognition is just one of the means through which our representation of the world is built. We propose an operationalization of subjective experience in the context of deep neural networks (DNNs) that could encourage a more thorough comparison of human and artificial vision.

Building on our diverse research traditions in the study of reasoning, language and communication, the Polish School of Argumentation integrates various disciplines and institutions across Poland in which scholars are dedicated to understanding the phenomenon of the force of argument. Our primary goal is to craft a methodological programme and establish organisational infrastructure: this is the first key step in facilitating and fostering our research movement, which joins people with a common research focus, complementary skills and an enthusiasm to work (...) together. Stanowi on rezultat badań zjawiska niepełnosprawności i kategorii społecznej, jaką stanowią osoby niepełnosprawne, oraz funkcjonowania ponad 30 agencji zatrudnienia wyspecjalizowanych we wsparciu osób niepełnosprawnych na rynku pracy. Pierwszy rozdział ekspertyzy dotyczy sposobów definiowania zjawiska niepełnosprawności, w drugim zaś - podjęto zagadnienie budowania potencjału niepublicznych służb zatrudnienia osób niepełnosprawnych. It is the result of research on disability phenomenon and people with disabilities social category. It contains information about operations of more than 30 employment agencies specialized in helping people with disabilities into the labor market. First chapter of expertise relates to methods for defining the prevalence of disability and in the second - it was the issue of capacity building for non-disabled employment services. Third chapter of the report provides information on the methodology of research, and the fourth presents the results of an empirical analysis of the collected material in relation to the offer of employment agencies and their clients. Theme of the fifth chapter of the work is the condition of the disabled employment agency run by NGOs. Theme of the next chapter is the external environment of employment agencies. Summary The aim of this paper is to analyse the chronology and itinerary of the march of the Macedonian army during the last days (September 18–October 1) of the Gaugamela campaign in 331 BC in the light of literary sources, cuneiform data, topographic and archaeological data, and GIS capabilities. The overall aim of this analysis is to contribute to the topographical enigma of the identification of Gaugamela as either (in the vicinity of) Tell Gomel or Karamleis/qaraqosh. The cuneiform data allows (...) us to establish the most important dates of the final course of the Gaugamela campaign: the Tigris crossing on September 18, a lunar eclipse on the evening of September 20, and the battle on October 1. Furthermore, a critical analysis of Arrian and Curtius suggests that the Macedonians spent only six days on the march and four days in the camp. Given the estimated average rate of the march of the Macedonian army, it is possible to reject certain routes between the Tigris crossing and Gaugamela and consider others as more or less likely. It is concluded that the Macedonians crossed the Tigris in the vicinity of modern Basorin and not Abu Dhahir or Abu Wajnam, as is widely assumed. Furthermore, it is also demonstrated that the difference between Tell Gomel and Karamleis/qaraqosh, regarding their distance from Arbela, is much less striking than is frequently assumed, and as such does not speak against any of the widely held identifications of Gaugamela. In September 2018, the ArgDiaP association, along with colleagues from Germany and the UK, organised one of the longest and most interdisciplinary series of events ever dedicated to argumentation - Warsaw Argumentation Week, WAW 2018. The eleven-day ‘week’ featured a five day graduate school on computational and linguistic perspectives on argumentation (3rd SSA school); five workshops: on systems and algorithms for formal argumentation (2nd SAFA), argumentation in relation to society (1st ArgSoc), philosophical approaches to argumentation (1st ArgPhil), legal argumentation (2ndMET-ARG) (...) and argumentation in rhetoric (1st MET-RhET); and two conferences: on computational models of argumentation (7th COMMA conference) and on argumentation and corpus linguistics (16th ArgDiaP conference). WAW hosted twelve tutorials and eight invited talks as well as welcoming over 130 participants. All the conferences and workshops publish pre- or post-proceedings in the top journals and book series in the field. (shrink)

Many countries employ systemic methods of protecting consumers from unfair business practices. One such practice is the use of abusive clauses in business-to-consumer (B2C) contracts, which unfairly impose additional obligations on the consumer or deprive them of their due rights. This article presents an information system that utilizes artificial intelligence methods to automate contract analysis and to detect abusive clauses. The goal of the system is to support the entire administrative process, from contract acquisition, through text extraction and the recommendation (...) of potentially abusive clauses, to the generation of official administrative documents that can be sent to court or to the owners of firms. This article focuses on on the components that use machine learning methods. The first is an intelligent crawler that is responsible for automatically detecting contract templates on websites and retrieving them into the system. The second is a document analysis module that implements a clause recommendation algorithm. The algorithm employs transformer-based language models and information retrieval methods to identify abusive passages in text. Our solution achieved first place in a competition on the automatic analysis of B2C contracts organized by the Polish Office of Competition and Consumer Protection (UOKiK), and has since been implemented as an official tool to support the contract analysis process in Poland. The case of Alta Fixsler, where a judge ruled that withdrawing life sustaining care was in her best interest rather than transferring her to Israel, as her parents wanted, is the latest in a series of controversial paediatric best interest decisions. Using this case, as well as some other recent cases, I argue that the UK exhibits a high degree of medico-legal paternalism in best interest decisions, even though paternalism seems to be ubiquitously negatively perceived in medical ethics. Firstly, I (...) explain what I mean by medico-legal paternalism and defend my claim that this phenomenon is present in the UK. I then argue that at least philosophically (rather than legally) such a situation is impossible to justify in a secular state and that how we treat paediatric best interest decisions is very different from other areas of medical law. The article addresses the theme of spectrality, the givenness of the other who remains here after departure as a ghost. It explores how this spectrality functions in Plato’s funeral oratory in the Menexenus dialogue. In the first part, the article discusses J. Patočka’s account of the specific givenness of the departed, which is experienced as a privation of a former intersubjectively intertwined life. The deceased other causes a twofold crisis. On the one hand, with the death of the other also (...) comes the withering of part of myself, for I am unable to realise possibilities dependent on his or her presence. On the other hand, the meaning of the other’s project, which becomes institutionalised through participation in the events and re-formation of the world, is endangered if no one is willing to take on and realise this meaning as one’s own. The second part of the article discusses how Socrates’ oratory addresses this crisis through specific temporality of the speech, one in which the past provides the present with a paradigm for appropriate civic action which is to be imitated in the future. In this context, he creatively uses the concept of shame to induce an attitude of responsibility for the polis, whose greatness is grounded in the virtuous deeds of spectrally present ancestry. In his Berlin Lectures of the 1820s, the German philosopher Arthur Schopenhauer (1788–1860) used spatial logic diagrams for philosophy of language. These logic diagrams were applied to many areas of semantics and pragmatics, such as theories of concept formation, concept development, translation theory, clarification of conceptual disputes, etc. In this paper we first introduce the basic principles of Schopenhauer’s philosophy of language and his diagrammatic method. Since Schopenhauer often gives little information about how the individual diagrams are to be understood, (...) we then make the attempt to reconstruct, specify and further develop one diagram type for the field of conceptual analysis. Daniel Ciunajcis Marcin Moskalewicz Time-Space of History. Transcendental Conditions of Practicing History as PoliticsThe article deals with the issue of time-space in modern historiography, and the main thesis is that time-space is a transcendental condition of the possibility of the practice of history and that modern victory of time over space has various negative implications that are underscored and analyzed. In the first part of the article, the authors present classical asymmetric concepts – Greeks vs. Barbarians and Christians vs. (...) Pagans – as analyzed by Reinhardt Koselleck. In the second part of the article, the advent of a new Christian temporality is being examined via Karl Barth’s interpretation (as presented in his Dogmatics in Outline) of Pontius Pilate’s last judgment over Jesus Christ. In this context three aspects of temporality are being discerned: the horizon of expectation represented by Jesus Christ, the space of experience represented by the Jewish community and eternity represented by Pontius Pilate. Pilate is recognized as taking the place of God in the political order: himself an embodiment of state, a symbol of its transcendence, and a transcendental condition of possibility of modern political life. In the third part the authors defend the thesis that thinking is an embodied phenomenon. While applying and criticizing Hannah Arendt, they indicate that thinking should be taken as an original source of human temporality and as a condition of possibility of organizing external space. The authors emphasize Arendt’s conception of a metaphor as a bridge between the sensible and the supersensible, with due attention to both differences and similarities between thinking and acting. Next, the authors analyze some consequences of their thesis for storytelling and political history being organized today mostly according to mere chronological paradigm. In the fourth part of the article, the authors pay attention to spatial organization of politics, arguing against Karl Schlögel, who claims that in late modern times national historiography was responsible for the dominance of the spatial paradigm. The argument defended is that even in the case of seemingly spatial organization of politics and history – as for example in a map – the temporal order is playing a predominant, even if hidden, role, and that space is being analyzed and valued according to temporal criteria. The predominantly temporal dynamics of modernization and modern supremacy of the future – as presented in the Geschichtliche Grundbegriffe Lexicon by Bielefeld School – is interpreted as a sign of loss and a symptom of narrowing our image of history. The field of organizational storytelling research is productive, vibrant and diverse. Over three decades we have come to understand how organizations are not only full of stories but also how stories are actively making, sustaining and changing organizations. This edited collection contributes to this body of work by paying specific attention to stories that are neglected, edited out, unintentionally omitted or deliberately left silent. Despite the fact that such stories are not voiced they have a role to play in organizational (...) analysis. The chapters in this volume variously explore how certain realities become excluded or silenced. The stories that remain below the audible range in organizations offer researchers an access to study political practices which marginalise certain organisational realities whilst promoting others. This volume offers a further contribution by paying heed to silence and the processes of silencing. These silences influence the choice of issues on organisational agendas, the choice of audience to which these discourses are addressed and the ways of addressing them. In exploring these relatively understudied terrains, Untold Stories in Organizations comprises an important contribution to the organizational storytelling space, opening paths for new trajectories in storytelling research. In this article, after presenting the basic idea of causal accounts of implementation and the problems they are supposed to solve, I sketch the model of computation preferred by Chalmers and argue that it is too limited to do full justice to computational theories in cognitive science. I also argue that it does not suffice to replace Chalmers’ favorite model with a better abstract model of computation; it is necessary to acknowledge the causal structure of physical computers that is not (...) accommodated by the models used in computability theory. In this paper, I offer an account of the dependence relation between perception of change and the subjective flow of time that is consistent with some extant empirical evidence from priming by unconscious change. This view is inspired by the one offered by William James, but it is articulated in the framework of contemporary functionalist accounts of mental qualities and higher-order theories of consciousness. An additional advantage of this account of the relationship between perception of change and subjective time is (...) that is makes sense of instances where we are not consciously aware of changes but still experience the flow of time. Dear Editor, -/- One of the recent changes in the UK cabinet, after Liz Truss became the Prime Minister, was that Dr Therese Coffey become the new Health Secretary. Some news outlets were quick to point out her anti-abortion stance (see e.g. (1–3)) and that this, according to them, might be a problem. While pro-lifers might not completely rejoice over this situation as Coffey stated that ‘she wouldn’t “seek to undo” abortion laws’(3), I do not wish to focus here on (...) speculating on the future status of UK abortion legislation. Rather, I wish to focus on some statements quoted by the media as made by Clare Murphy, chief executive of the British Pregnancy Advisory Service (BPAS), who stated that: (2,4) -/- ‘Earlier this year, our new Health Secretary voted to revoke access to at-home abortion care, and recriminalise women who end their own pregnancies without the approval of two doctors.’ ‘In doing so, Therese Coffey voted against the advice of leading medical bodies.’ ‘To have a health secretary who would place their personal beliefs above expert clinical guidance is deeply concerning.’ -/- Coffey is a Catholic, and this brings back to mind some of the aspects of the debate surrounding conflicts of interest in bioethics. There have been, for example, discussions and proposals that having a religious belief should be declared as a conflict of interest.(5,6) But something seems to be missing in these portrayals of conflict of interest and the disagreement between Coffey and these ‘leading medical bodies’. If we regard financial conflicts of interests as the classical case of such conflicts that is used as a reference to other types of conflicts of interest,(5,6) then why do we not see the media complaining that ‘leading medical bodies’ support procedures that will give them more work oppor-tunities and improve their financial stability? To paraphrase Murphy who (according to the BBC 'said while politicians were entitled to their own views on abortion, what mattered was whether their "personal convictions stand in the way of women's ability to act on their own”. (4) perhaps ‘BPAS and the leading medical bodies are entitled to considerations of their financial interests, but what matters is whether the advice they give is clinically sound and founded in the principles of ethical clinical practice. In Matthew 6:24 Our Lord said that one cannot serve two masters, so perhaps we should not be so concerned with Coffey consulting her conscience, but rather scrutinise clinical institutions. (shrink)

Wonderful Knowledge. Aquinas on the Immutability and Eternity of God’s Knowledge The general concept of knowledge is a kind of concept closely akin to transcententals: its use is not restricted to a certain kind of being, and it does not itself designate a kind of entity. Such concepts may be applied to God not as metaphors: when we grasp (through the analysis of cases of finite knowledge) some general traits of knowledge as such, we can show that God has knowledge, (...) and his knowledge, as opposed to ours, is infinitely perfect. We have no insight into this realization of knowledge as opposed to ours, but as far as we know what general traits of knowledge are, it is important to know that God has infinitely perfect knowledge. To grasp the general traits of knowledge, I focus on the topic of mutability and immutability of knowledge analyzed systematically by Aquinas, and thus on the topic of identity criteria specific for knowledge in general: the question of when knowledge that p and knowledge that q are (in a certain knower) one and the same knowledge; the criteria of identity of knowledge vary according to natures of knowers. I think that the problem of the criteria of identity of knowledge is rather neglected in omniscience-immutability discussions. I analyze Aquinas’ arguments for the thesis that human knowledge is mutable, and God’s knowledge is absolutely immutable (they concern the role of tense). The analysis sheds light on some general traits of knowledge: it is always something formulated by the knower which manifests some truth to him, and in general the way it is formulated corresponds to (i) the way it manifests some truth, (ii) its identity criteria, (iii) the way it is propositional, (iv) the way it is related to tense, and finally (v) the nature of the knower. Focusing on the criteria of the identity of knowledge shows that God’s knowledge is absolutely immutable, and that time and change in its objects are nevertheless undoubtedly real. Il magistero aristotelico nella zoologia comparata rimane saldo fino a tempi di scienza moderna, perché non muta in sostanza nei secoli il metodo aristotelico costituito dalla combinazione dei dati anatomici con quelli fisiologici. Pertanto la straordinaria stabilità assunta dalla biologia aristotelica richiede una riflessione sulle fonti storiche di essa e sui fondamenti del metodo scientifico impiegato da Aristotele nel quadro del suo pensiero biologico presentato in maniera complessiva nelle opere De partibus animalium e Historia Animalium. La riflessione su alcuni aspetti (...) del suo pensiero biologico, ovvero sulla questione della causalità, della sostanza, del metodo dicotomico e comparativo, possa spiegare anche come esse abbiano a un certo punto svolto un ruolo di stimolo e di verifica anche per i temi più generali del suo pensiero filosofico. In effetti, con Aristotele il sapere teoretico della biologia ha conquistato per la prima volta in modo sistematico il grande terreno della natura vivente. To date, bioethics and health policy scholarship has given little consideration to questions of aging and intergenerational justice in the developing world. Demographic changes are precipitating rapid population aging in developing nations, however, and ethical issues regarding older people’s claim to scarce healthcare resources must be addressed. This paper posits that the traditional arguments about generational justice and age-based rationing of healthcare resources, which were developed primarily in more industrialized nations, fail to adequately address the unique challenges facing older persons (...) in developing nations. Existing philosophical approaches to age-based resource allocation underemphasize the importance of older persons for developing countries and fail to adequately consider the rights and interests of older persons in these settings. Ultimately, the paper concludes that the most appropriate framework for thinking about generational justice in developing nations is a rights-based approach that allows for the interests of all age groups, including the oldest, to be considered in the determination of health resource allocation. When discussing the safety of research subjects, including their exploitation and vulnerability as well as failures in clinical research, recent commentators have focused mostly on countries with low or middle-income economies. High-income countries are seen as relatively safe and well-regulated. This article presents irregularities in clinical trials in an EU member state, Poland, which were revealed by the Supreme Audit Office of Poland (the NIK). Despite adopting many European Union regulations, including European Commission directives concerning Good Clinical Practice, these irregularities (...) occurred. Causes as well as potential solutions to make clinical trials more ethical and safer are discussed. (shrink)

Artykuł analizuje krytycznie pewne linie argumentacji stosowane przez wielu badaczy Nowego Testamentu na poparcie negatywnej oceny przekazów na temat wypowiedzi Jezusa i wydarzeń w Ewangeliach synoptycznych.

It has been noticed by several authors that the colloquial understanding of anonymity as mere unknown-ness is insufficient. This common-sense notion of anonymity does not recognize the role of the goal for which the anonymity is sought. Starting with the distinction between the intentional and unintentional anonymity (which are usually taken to be the same) and the general concept of the non-coordinatability of traits, we offer a logical analysis of anonymity and identification (understood as de-anonymization). In our enquiry, we focus (...) on the intentional aspect of anonymity and develop a metaphor of “anonymity game” between “perpetrator” and “detective”. Beginning from common-sense intuitions, we provide a formalized, critical notion of anonymity. (shrink)

The purpose of this paper is to analyse and compare two concepts which tend to be treated as synonymous, and to show the difference between them: these are critical thinking and logical culture. Firstly, we try to show that these cannot be considered identical or strictly equivalent: i.e. that the concept of logical culture includes more than just critical thinking skills. Secondly, we try to show that Christian philosophers, when arguing about philosophical matters and teaching philosophy to students, should not (...) focus only on critical thinking skills, but rather also consider logical culture. The article is addressed to the issue of conscience in the thought of Hannah Arendt and to the question under what conditions conscience can become manifest in the public sphere. The article is divided into four parts. The first renders Arendt’s motivation to reconsider the concept of conscience, which results from an endeavour to come to terms with the nature of political crimes of the 20th century and the banality of evil. In the second part, two constitutive qualities of conscience (...) are presented. On the one hand, conscientious Self adopts a negative distance from moral rules held by wide society. On the other hand, it positively relies on self-interest, that is, on non-contradiction in relation to oneself. Both of these crucial qualities of conscience arise from the activity of thinking. The third part addresses the conflicting relation of individual conscience to the public sphere. In the final part, the author asks the question whether the concept of conscience can be politically justified and sets the conditions for a defence of freedom of conscience in the public space.
